Terms of Service

These terms govern the use of Piaflo - WhatsApp Flows ("Piaflo", "the Service"), a Shopify app operated by monweb.dev ("we"), by the merchant who installs it ("you"). By installing the app you accept these terms, the Privacy Policy and the Data Processing Agreement, which forms part of these terms.

1. The Service

Piaflo connects your own WhatsApp Business account to your Shopify store to send order notifications, automated flows and campaigns, and to reply to customers in a shared inbox. Features depend on your plan.

2. Your WhatsApp Business account

• You connect a WhatsApp Business account and phone number that you own, through Meta's signup flow operated by our connectivity provider. You remain the owner of that account, its phone number and its message templates.
• You accept and comply with Meta's terms, including the WhatsApp Business Messaging Policy, the WhatsApp Commerce Policy and the Meta Business Terms. Meta may restrict or suspend your account; we are not responsible for Meta's decisions.
• WhatsApp message fees are billed by Meta directly to your WhatsApp Business account, at Meta's rates. Piaflo does not resell messages and adds no markup. Cost estimates shown in the app are indicative.

3. Your obligations

You agree to:

• message only customers who gave the consent required by law and by Meta (marketing consent for promotional messages), and to keep proof of consent collected outside Piaflo;
• honor opt-outs (Piaflo stops messages automatically when a customer replies STOP);
• inform your customers, in your privacy notice and at checkout, that you use WhatsApp to send order updates and, if applicable, marketing messages;
• not use the Service for unlawful, misleading, abusive or prohibited content, or for products and services restricted by Meta's policies;
• not send sensitive data (payment card numbers, health data, government identifiers) through the Service;
• keep your Shopify and Meta accounts secure.

We may suspend sending from your store, after notice where possible, if your use puts your number, other merchants or the Service at risk.

4. Plans and billing

• Plans and prices are shown in the app and billed by Shopify through Shopify App Pricing. Paid plans include a free trial as shown at subscription. You can change or cancel your plan at any time from the app; Shopify handles proration and invoicing.
• Plan limits (subscribed contacts, flows, seats, features) are enforced by the app. When a limit is reached, new marketing messages wait until you upgrade; order notifications continue on all plans.

5. Data

• You are the data controller for your customers' personal data; we process it as your processor under the Data Processing Agreement.
• You can export your data on request before uninstalling. When you uninstall, your automations stop immediately and all your store data is deleted within 48 hours of Shopify's shop/redact request.

6. Availability and support

We aim for high availability but do not guarantee uninterrupted service; Shopify, Meta and our providers may also have outages. Support is provided by chat and at [email protected].

7. Intellectual property

The Service, its code, design and content belong to us. Your content (messages, templates, store data) belongs to you; you grant us the rights needed to provide the Service.

8. Liability

To the maximum extent permitted by law: the Service is provided "as is"; we are not liable for indirect damages, lost profits or revenue, or for actions taken by Meta or Shopify; our total liability is limited to the amounts you paid for the Service in the 12 months before the claim. Nothing limits liability that cannot be limited by law.

9. Changes and termination

We may update these terms; material changes are notified in the app or by email at least 30 days in advance. You may stop using the Service at any time by uninstalling the app.

10. Governing law

These terms are governed by French law. Disputes fall under the jurisdiction of the competent courts of France, without prejudice to mandatory consumer protection rules.
